Californias New eBike Laws for 2026 Are Here!

California has long been a leader in bicycle and micromobility policy. As of January 1, 2026, that leadership continues with the implementation of SB 1271, a law that strengthens safety requirements for electric bicycles sold or leased in the state.

For riders in Venice, Santa Monica, and along the Beach Bike Path, this update matters more than ever. Local agencies have announced increased enforcement, ticketing, and bike confiscations for non-compliant e-bikes operating on shared-use paths.

What Changed With California’s 2026 E-Bike Law (SB 1271)

 

SB 1271 was introduced to address growing concerns around battery fires, overpowered motors, and e-bikes that blur the line between bicycles and motor vehicles—especially in dense coastal areas with heavy pedestrian traffic.

Starting in 2026, all new e-bikes sold or leased in California must meet clearer, stricter safety and classification requirements to remain legal on bike paths, lanes, and shared-use infrastructure.

In places like Venice Beach and Santa Monica, where bike paths are heavily used and closely monitored, these rules are actively enforced.

 

 


Active Enforcement on Venice & Santa Monica Bike Paths

 

Local agencies have confirmed that bike path enforcement is increasing along the Marvin Braude Bike Trail and surrounding areas.

Riders should expect:

  • Ticketing for improperly classified or overpowered e-bikes
  • Confiscation of e-bikes that do not meet California’s legal definition
  • Enforcement focused on bikes with throttles where they’re not permitted, excessive motor power, missing labels, or unsafe battery systems

If a bike is found to exceed legal limits—or can be easily modified to do so—it may be treated as an unregistered motor vehicle, even if it resembles a bicycle.

This is not theoretical. Enforcement is happening now, particularly in high-traffic coastal zones.


UL 2849 Battery Safety Is Now Mandatory

One of the most significant updates involves battery and electrical system safety.

California now requires UL 2849 certification, an internationally recognized safety standard designed to reduce the risk of:

  • Battery overheating
  • Electrical failure
  • Charging-related fires

In practical terms:

  • Unverified or “no-name” battery systems can no longer be sold legally
  • Every compliant e-bike must carry proof of UL certification
  • If an e-bike does not meet UL 2849 standards, it cannot be sold—or legally operated—on California bike paths

The 750-Watt Motor Limit: Keeping Bikes Legal on the Path

 

To protect riders and pedestrians, SB 1271 enforces a maximum motor output of 750 watts.

E-bikes that can be “unlocked,” modified, or overridden to exceed legal limits are no longer considered bicycles. On the beach path, that distinction matters—because non-compliant bikes may be stopped, cited, or removed.

To stay legal on Venice and Santa Monica bike paths, an e-bike must:

  • Remain capped at 750W
  • Maintain its factory class settings
  • Avoid hidden or user-accessible power overrides


Clearer E-Bike Class Definitions (And Why They Matter Locally)

 

SB 1271 tightens enforcement of California’s e-bike class system:

 

Class 1

 

  • Pedal-assist only
  • Assistance up to 20 mph

 

Class 3

 

  • Pedal-assist only
  • Assistance up to 28 mph
  • Speedometer required

Throttles are not permitted on Class 1 or Class 3 bikes

A limited walk mode (under 4 mph) is allowed

Class 2

  • Throttle-assisted
  • Throttle limited to 20 mph

On shared-use paths like those in Venice and Santa Monica, misclassified bikes are a primary enforcement target.

 

Permanent Labeling Is Required

Every e-bike sold or leased must now include permanent labeling identifying:

  • E-bike class
  • Motor power
  • Compliance status

Missing or altered labels can result in citations or confiscation, even if the bike otherwise appears compliant.
